TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of GruossoGroup.com (the "Website"), our text message program, and the business software and API integrations operated by The Gruosso Group, part of G&G Realtors ("Company," "we," "our," or "us"). By using the Website, submitting a form, or connecting an account to our software, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use them.

1. Our Services

The Website provides information about The Gruosso Group, properties for sale or lease, and our real estate services. It also lets you contact us. Using the Website or submitting a form does not by itself create an agency, brokerage or client relationship. Any such relationship begins only when you sign a written agreement with us, as New Jersey law requires.

2. Property Listings and Information

Listing information on the Website is provided in part through Internet Data Exchange (IDX) from multiple listing services and other sources. It is deemed reliable but is not guaranteed. Properties may be sold, withdrawn or changed in price at any time. Square footage, lot size, taxes, school districts and other details should be verified independently. IDX information is provided for consumers' personal, non-commercial use and may not be used for any purpose other than identifying properties you may be interested in buying or leasing.

3. Estimates, Calculators and Market Information

Home value estimates, return-on-investment calculators, market statistics and similar tools are general information only. They are not appraisals, and they are not legal, tax, financial, mortgage or investment advice. Consult a qualified professional before you make a decision based on them.

4. Equal Housing Opportunity

We are committed to the letter and spirit of federal, state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, or any other class protected by the New Jersey Law Against Discrimination.

5. Text Message Program

If you give us your mobile number and consent to receive text messages, The Gruosso Group may text you about your inquiry, appointments, listings, transactions and related real estate services.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to any message to opt out.
• Reply HELP for help, or call (908) 489-4107.
• Consent to receive text messages is not a condition of buying, selling or renting any property, or of receiving any service.
• Mobile carriers are not liable for delayed or undelivered messages.
• Your mobile information is handled as described in our Privacy Policy. It is never shared with third parties for their marketing purposes.

6. Business Software and API Integrations

The Gruosso Group operates internal business software that connects to third-party platforms, including Google, Meta (Facebook and Instagram), TikTok and LinkedIn, through their official APIs. That software is provided only to The Gruosso Group and its agents; it is not offered to the public. If you connect an account to it, these terms apply:

• Authority. You may connect only an account that you own or are authorized to manage on behalf of The Gruosso Group.
• Platform terms. Your use of each connected platform remains subject to that platform's own terms and policies, including the Google APIs Terms of Service, the Meta Platform Terms, the TikTok Developer Terms of Service and the LinkedIn API Terms of Use. We use each platform's API in accordance with those terms.
• Permissions. We request only the permissions needed for the features we provide, and we use data only as described in our Privacy Policy.
• Your control. Nothing is posted, sent, changed or paid for on a connected account unless you take that action deliberately. Ad campaigns are created paused and begin spending only after you explicitly confirm the budget.
• Revoking access. You may disconnect an account at any time in our software or in the platform's settings. See Data Retention and Deletion for how to revoke access and have data deleted.
• Availability. Third-party platforms may change, limit or discontinue their APIs at any time. We are not responsible for features that stop working as a result.
• Content you publish. You are responsible for reviewing any post, advertisement or message before you publish or send it, including for compliance with fair housing and real estate advertising rules.

The Gruosso Group is not affiliated with, endorsed by or sponsored by Google LLC, Meta Platforms, Inc., TikTok Ltd. or LinkedIn Corporation. Their names are used only to identify the services we connect to.

7. Acceptable Use

You agree not to:

• Use the Website or our services for any unlawful purpose;
• Copy, scrape or harvest listing data or other content with automated tools, or use it for any commercial purpose;
• Submit false information, or information about another person without their permission;
• Try to gain unauthorized access to the Website, our software or any connected account, or interfere with how they work;
• Upload or transmit viruses or any other harmful code.

8. Intellectual Property

The Website's content, including text, photographs, video, graphics and logos, belongs to The Gruosso Group or its licensors and is protected by copyright and trademark law. You may view and share it for personal, non-commercial purposes. You may not reproduce, modify or distribute it for any other purpose without our written permission.

9. Third-Party Links and Services

The Website and our software may link to or rely on services operated by others, such as lenders, title companies, social media platforms and mapping providers. We do not control those services and are not responsible for their content, availability or privacy practices.

10. Disclaimer of Warranties

The Website, our software and all information provided through them are provided "as is" and "as available," without warranties of any kind, express or implied. This includes, without limitation, warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that they will be uninterrupted, secure or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, The Gruosso Group, G&G Realtors and their agents and employees are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business opportunity, that arise from your use of the Website, our text message program or our software. This applies even if we were told such damages were possible.

12. Indemnification

You agree to indemnify and hold harmless The Gruosso Group, G&G Realtors and their agents and employees from any claim, loss or expense, including reasonable attorneys' fees, that arises from your breach of these Terms or your misuse of the Website or our services.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in New Jersey.

14. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its effective date. Continued use of the Website or our services after a change means you accept the revised Terms.
